Steps to Take After a Truck Accident

Immediately following a truck accident, there are certain steps you should take to ensure your well-being and protect your claim to help secure your right to compensation. This includes:

  1. Calling 9-1-1 and reporting the accident to local law enforcement. The officer will complete an accident report which can be a critical piece of evidence for your claim.
  2. Seeking medical treatment for your injuries, even if you think they are minor. Seeing a doctor to document your injuries and following his or her treatment plan could help improve your chances of recovering compensation.
  3. Exchanging and gathering information from all parties involved in the accident. This includes names, addresses, phone numbers, insurance information and driver’s license numbers.
  4. Talking to any witnesses present at the time of your accident and taking down their contact information. Eyewitness statements can provide a valuable insight into how the accident happened and which party may be liable for your injuries.
  5. Documenting the accident scene by taking pictures of the scene, your injuries and damage to any vehicles or property if you are physically able to. Photographs can serve as invaluable evidence of the severity of your injuries, the accident and the underlying causes of the crash.
  6. Being careful about what you say regarding your accident. Provide only the basic facts of the accident to officers and insurance company representatives, but do not admit fault. What you say can be used against you, particularly by insurance companies who have their best interests in mind, not yours.
  7. Seeking legal assistance from a knowledgeable attorney who can handle every aspect of your claim. This includes communicating with insurance companies on your behalf to obtain the justice and compensation you are entitled to.

Following these steps can help you document what happened and link your injuries to the accident. It will also help your Hartford truck accident lawyer as he or she investigates and begins building your case.

How Can a Hartford Truck Accident Attorney Help Me?

Truck accidents can involve multiple parties aside from the truck driver and victim, which means one or more parties can be held liable. This can include the trucking company, the truck driver’s employer, the company that loads or unloads the cargo or the manufacturer of the truck. This is one of the reasons truck accidents cases are much more complicated than car accident cases.

This is why it may be in your best interest to contact a qualified attorney who can help you navigate through the legal process. Trucking companies and their insurance companies will be looking to offer you the lowest settlement they can so you should have someone advocating for your best interests.

A professional truck accident lawyer in Hartford can help you in the following ways:

  • Analyzing the facts of your situation to determine if you have a valid case
  • Documenting and preserving any evidence that will help build a strong case
  • Taking pictures, speaking to witnesses who were present at the scene and finding any other important evidence to prove your case
  • Taking care of all the paperwork and making sure things are filed within the deadlines
  • Reviewing your case with a medical expert who can determine the true extent of your injuries and the ways they will affect you moving forward
  • Communicating with the insurance companies on your behalf to advocate for your best interests
  • Calculating the full value of your damages as we pursue favorable compensation

During your free consultation, we will explain the process of moving forward with your truck accident case and the forms of compensation you may be entitled. If a settlement cannot be reached, our lawyers are prepared to initiate a lawsuit and help you pursue compensation in court.

Common Causes of Truck Accidents

Negligence is one of the most common causes of truck accidents. Our dependable Hartford truck accident lawyers are ready to provide thorough and aggressive representation to help victims recover compensation for all types of driver negligence, including:

  • Speeding
  • Reckless driving
  • Distracted driving
  • Unsafe lane changing
  • Aggressive driving
  • Impaired driving
  • Driver fatigue
  • Improperly loaded cargo
  • Poor vehicle maintenance
  • Failing to yield or stop
  • Driving in bad weather conditions
  • Failure to check blind spots
  • Inadequate experience or training
  • Following too closely

Although truck drivers and truck companies are responsible for maintaining a truck, sometimes certain parts are defective and do not work as they were intended. Some truck accidents could have been avoided if the manufacturer of the truck had not designed or manufactured a dangerous and defective truck part. Common defective truck parts that can cause a severe accident include:

  • Tires
  • Brakes
  • Steering
  • Axles
  • Hydraulics

If you believe your injuries sustained in a truck accident were caused by negligence or unsafe driving practices, a truck accident lawyer in Hartford is ready to assist.

Truck Accident Injuries

Truck accident injuries can be severe and life-changing. Often times, it may take many years to recover from an accident. Sometimes a full recovery is not possible, which can greatly decrease your quality of life.

Truck accidents often leave victims with:

  • Head/brain injuries – The force of a truck accident can cause significant trauma to the brain. Symptoms of a head or brain injury can range from a mild concussion to severe side effects such as slurred speech, confusion, memory and concentration problems, persistent headaches, vision problems and other cognitive issues.
  • Broken bones – The impact of a truck accident can cause breaks or fractures in the arms, legs, hands, wrists, pelvis, ribs and face.
  • Back and neck injuries – Injuries to the back and neck can be some of the most severe and debilitating. Whiplash can cause numbness and pain in the neck and upper limbs when the head is thrust forward suddenly in an accident. Back injuries can affect the discs or muscles, or cause damage to the spinal cord, resulting in temporary or permanent paralysis.
  • Internal injuries – Blunt force trauma from a crash can cause internal injuries to organs such as the bladder, kidney, heart, lungs, liver, spleen and pancreas. Organs can become damaged or perforated, causing internal bleeding which is often difficult to treat.
  • Burns – Fuel tanks can explode or rupture, leading to fires and burn injuries. Burns can cause severe pain, blistering, scarring and disfigurement. In the most serious cases, burn injuries can be fatal.
  • Seat belt injuries – Seat belts help protect you in the event of an accident. However, these safety devices can also result in injury when the body is thrown forward against a seat belt. Injuries can include pain in the chest, shoulders or stomach, bruising, broken ribs, abrasions and lacerations.

If you have suffered severe injuries after a truck accident, it is important to seek immediate medical attention. If left untreated, even the most minor injuries can become worse over time.

A reputable Hartford truck accident attorney at our firm can evaluate your claim and help you pursue compensation for your medical bills, lost wages, and pain and suffering.

Types of Truck Accident Cases We Handle

At D'Amico & Pettinicchi, our truck accident lawyers in Hartford know how to handle different types of complex truck accident cases involving:

Head-On Collisions

These collisions occur when a truck driver or another motorist crosses the center divider line into oncoming traffic and crashes into another vehicle head-on. Drivers under the influence of drugs or alcohol, and drivers who are distracted or drowsy are more likely to cause these often-fatal collisions.

Sideswipe Accidents

Semis and 18-wheelers have large blind spots so truck drivers have trouble seeing all the cars around them. They must use caution when changing lanes, otherwise they could sideswipe vehicles in the lanes next to them. These accidents can also happen when truck drivers drift out of their lanes because they are tired or under the influence of drugs or alcohol.

Jackknife Crashes

A jackknife crash can occur when a truck driver slams on the brakes and they lock up, causing the trailer to swing out at a 90-degree angle to the cab. An 18-wheeler that jackknifes is completely out of control, which increases the risk of a serious or possibly fatal accident.

Rollover Collisions

Large trucks have a higher center of gravity compared to smaller motor vehicles. This increases a truck’s chances to rollover on its side in the event of a collision. These accidents can occur as a result of speeding or cutting a corner too fast and over-correcting the steering wheel.

Rear-End Accidents

Due to their weight, trucks need more space and time than smaller motor vehicles to slow down and come to a stop. Truck drivers that are fatigued, drowsy or impaired may have slower reaction times to stop and avoid a hazard in the road or other vehicles that have slowed down. Rear-end accidents are often fatal for any motorist involved.

Underride Crashes

These can lead to some of the deadliest types of injuries in truck accidents. These occur when a car hits the back of a truck but slides underneath it.

Lost Cargo Collisions

When cargo is not properly secured or is overloaded on trucks, it can lead to lost cargo collisions. The cargo ends up falling off or hitting other motor vehicles and creating roadway hazards that can be difficult to maneuver around.

While these types of trucks accidents can happen almost anywhere, they often occur on major highways in the Hartford area such as Interstate 84 and 91 and Route 15 and 2. Accidents on these busy roadways can be especially dangerous when vehicles are traveling at high speed.

Connecticut Trucking Regulations

The Connecticut Department of Transportation has several laws and regulations when it comes to the trucking industry. These laws help to ensure the safety of truck drivers and others on the road.

Length Limits

On all interstates and major highways, Connecticut has a limit on the length of a truck, including the load carried. The length limits are:

  • 28 feet for regular trailers
  • 45 feet for single unit trucks
  • 48 feet for semitrailers

There are no limitations when it comes to system trucks, such as multi-trailer trucks. There are also no length limits for combination semitrailer tractors or combination tractor semitrailers.

Width and Height Limits

Width limitations are important because the width of a truck can affect its weight. In Connecticut, the width limit for trucks is 102.37 inches with a height limit of 13 feet and six inches for any truck type.

If a truck is not in compliance with these width and height standards, the driver can be charged with an overweight truck offense. Fines are calculated by the percentage the truck is overweight for its size.

Weight Laws

According to Connecticut law, a truck’s proper weight is determined by how many axles the truck has and the distance between its axle groups (wheelbase). This is also known as the Federal Bridge Formula.

For example, a three-axle vehicle might qualify for no more than 53,800 pounds gross weight but be as much as 60,000 pounds under the bridge formula as long as the wheelbase is at least 32 feet.

For a two-axle truck, the weight limit is:

  • 32,000 pounds for a two-axle vehicle with no axle weight restrictions
  • 36,000 pounds when the axle weight does not exceed 18,000 pounds
  • Up to 40,000 pounds when the wheelbase is 10 feet or more

For a three-axle truck:

  • 53,800 pounds is the weight limit
  • 58,400 pounds is the weight limit for a three-axle combination truck, trailer, or semitrailer

For a truck with four or more axles:

  • 73,000 pounds is the weight limit
  • You can use the Federal Bridge Formula for up to 80,000 pounds
